On March 10-13, 2011, Natural Products Expo West will host its 31st annual trade show event for the burgeoning natural and organic industries. Manatt partner Ivan Wasserman will challenge attendees’ knowledge of marketing law when he hosts “Claim-a-Palooza!” — an interactive and entertaining ‘game’ that tests everyone’s FDA and FTC IQ.

Ivan will also participate in a panel presentation titled, “Crossing the Chasm: A Road Map for Retailers” in which he will examine communications between retailers and ingredient companies. Joining Ivan in this session are Steve Mister of the Council for Responsible Nutrition, and Don Summerfield of Pharmaca Integrative Pharmacy, with Anna Soref, Editor-in-Chief of Natural Foods Merchandiser, serving as moderator.

Advertising Law & Strategy Seminar

Linda Goldstein, Chair of Manatt’s Advertising, Marketing & Media Division, will convene with top law, advertising and marketing professionals to present in a full-day program on “Advertising Law & Strategy,” to be hosted by the Minnesota State Bar Association. Linda’s session, “Recent Trends and Developments in Advertising and Promotion Laws,” will explore key legal issues and challenges in conducting social media campaigns and launching successful mobile marketing campaigns, as well as highlight recent trends in comparative advertising challenges.

59th Annual Antitrust Spring Meeting

With consumer protection and antitrust ranking high on the list of regulatory and enforcement priorities, it’s crucial to stay ahead of the newest developments in these areas. To this end, the ABA Section of Antitrust Law is ramping up for its 59th Annual Antitrust Spring Meeting, bringing together a top-ranked faculty of government enforcers, practitioners, in-house counsel, economists and academics from around the globe. The roster of speakers includes Justice Antonin Scalia and Bryan Gardner, authors of Making Your Case: The Art of Persuading Judges, who will deliver a presentation focused on writing winning antitrust briefs.

On March 30, 2011, Linda Goldstein will join forces with her esteemed panelists – Heather Hippsley (Assistant Director, Division of Advertising Practices of the FTC’s Bureau of Consumer Protection) and Magnolia Mansourkia Mobley (Chief Privacy Counsel for Verizon Communications, Inc.) – to present on the topic of “Fundamentals – Consumer Protection.” They will explore the basics of consumer protection law, including false and deceptive advertising, promotions marketing law, and privacy and data security.

Advanced Legal Summit on Food & Beverage Marketing & Advertising

The FDA and FTC have clearly set their sights on scrutinizing the food and beverage industries during 2011. In light of this emerging development, ACI will hold its first-ever Legal Summit on Food & Beverage Marketing & Advertising from March 31 – April 1, 2011, in Washington, DC. To explore the types of evidence needed to meet FDA and FTC expectations for food and beverage product claims, and the role consumer perception plays in food advertising, Linda Goldstein will moderate a panel titled “Claim Substantiation: Navigating the Intersection of FDA & FTC Oversight Over Food Labeling and Advertising Claims.” The panelists joining Linda include Timothy Ernst (Vice President and Associate General Counsel, Del Monte Foods) and Denise Gough (Vice President, Legal Affairs, for Scripps Networks).

To help companies prepare for developments with respect to food product claims and regulatory requirements, Ivan Wasserman will moderate a panel titled “Knowing What Can and Cannot Be Said When Making Specific Food Product Claims: How to Ensure Compliant Health, Nutrition, Benefit, Function and Mental Performance Claims.” The panel will comprise Vincent de Jesus (Nutritionist for the Office of Nutrition, Labeling and Dietary Supplements, Center for Food Safety and Applied Nutrition of the FDA) and Kevin Goldberg (Vice President and General Counsel for Nestlé Nutrition).
