Trump Administration Alters States’ Authority in ACA Change

Trump Invites ACA Suits By Giving States New Leeway
– Law360

Manatt’s Joel Ario, a managing director with our Manatt Health team, was interviewed by Law360 about the Trump administration’s changes to the Affordable Care Act (ACA).

The publication noted that the administration gave states the option to lead consumers away from the ACA’s health insurance plans and steer them toward cheaper policies instead. This move has been considered controversial and has opened discourse on the potential impact on individuals with preexisting conditions.

“It’s clear that the spirit of the ACA was to fully protect people with preexisting conditions, and the only way to ensure people are treated the same is to have them in the same risk pool. Separate is never equal,” said Ario.
