Idaho Insurance Head Defends State Executive Order on Non-ACA Plans

Manatt’s Joel Ario, a managing director with Manatt Health, was interviewed by Inside CMS for an article on the Idaho insurance chief’s defense of the state’s executive order on non-Affordable Care Act plans.

The publication noted that Governor Butch Otter’s recent executive order and subsequent guidance permit insurance carriers to sell non-ACA-compliant plans. Industry experts have claimed that this proposed plan is illegal.

According to Ario, the new state plans would retain some of the ACA’s protections while also violating other ACA standards. These violations include no underwriting and a 3:1 age band that can only be changed by Congress.
