States Can Pay Health Plans That Don’t Check Obamacare Boxes

Manatt’s Joel Ario, a managing director with our Manatt Health team, was interviewed by Bloomberg Law for an article on the Trump administration’s guidance to redirect the Affordable Care Act’s (ACA’s) subsidies.

The publication noted that, with the new changes, states will now have the option to use federal funds to pay plans that do not cover individuals with preexisting conditions. Supporters consider this change as beneficial to states that want more freedom, while opponents consider it to be discriminatory toward those with preexisting conditions.

“It clearly allows a state to weaken preexisting condition protections for people who need comprehensive coverage in the ACA risk pool by showing that loss of affordability for them is compensated for by increased affordability for people buying short-term plans,” said Ario.
