How HHS Might Let States Decide Essential Health Benefits

In a Bloomberg BNA article, Manatt’s Joel Ario, a managing director with Manatt Health, discussed potential regulatory changes in governing the Affordable Care Act. The Department of Health and Human Services has legal latitude in this situation, and can use it whether or not the ACA is changed substantially by Congress.
 
“The essential health benefits are one of the areas where there’s more room because a lot of the current requirements are in regulation rather than in statute,” Ario told the publication.
