Dakota Access Refusal Looms Large for Future Energy Projects

Tribes’ Dakota Access Win Resounding, But Vulnerable

Law360 interviewed Manatt’s Craig Moyer, co-chair of the firm’s energy practice, for an article about the Obama administration’s recent refusal to grant permission to finish work on the highly publicized pipeline project in North Dakota. The publication reports that the Native American tribes’ elation may be only temporary as either federal courts or the incoming Trump team could put the controversial pipeline back on track.

Other energy companies will be watching the outcome of the Dakota Access suit closely, as the government's about-face could have a large impact on approvals of pipeline projects and other infrastructure, according to Moyer.

“This process was supposed to be a speedy process, and then the government change[d] the rules,” Moyer said. “That's not good for infrastructure development as a whole. Whether you believe this project is a good project or not, you have to look at the implications of the process for future projects.”
