Updates on California Medical Leave Laws


Manatt will present “Updates on California Medical Leave Laws,” a seminar that will provide guidance to employers attempting to comply with the evolving medical leave laws in California.

The seminar will take place in our Los Angeles on April 23, 2015 and in our Orange County office on Friday, April 24, 2015.

Our presenters will discuss the interplay between some of the many leave laws impacting California employees, including the following:

  • Preparing for California Paid Sick Leave law and some of the clarifications provided by the Department of Fair Employment and Housing related to the enforcement and application of the new laws
  • Status of the proposed updates to the California Family Rights Act (CFRA)
  • New developments related to the Family Medical Leave Act and the CFRA, including issues related to designating leave in light of the Escriba decision, including whether communications to employees can still be done via mail or email without verification of receipt, requiring an employee to have a fitness-for-duty medical exam upon return to work and the diligent good-faith-effort exception
  • Updates related to California’s disability laws under the California Fair Employment and Housing Act , including recent guidance by California courts on employer obligations in engaging in the interactive process and providing accommodation
  • Guidance and recommendations on best practices in updating existing policies or practices to ensure compliance with these and other leave laws
