Manatt Co-hosts How to Win Jury Trials in Trademark and False Advertising Cases

The Association of Corporate Counsel Greater New York Chapter & Manatt are pleased to present, "How to Win Jury Trials in Trademark and False Advertising Cases" on September 21, 2010 from 12:00 - 2:00 p.m. in the New York office of Manatt, 7 Times Square, New York, New York.

Most lawsuits involving trademarks, trade dress, and false advertising go forward as bench trials, and frequently do not proceed past the preliminary injunction stage. However, as demonstrated by recent cases in these fields, there are several circumstances where a jury trial is necessary.

Whether your company finds itself a plaintiff or a defendant in such a case, you should be prepared to entrust your case to a jury. Juries generally find these cases more interesting than the typical commercial dispute as they can more easily relate to the products and issues involved. Your company and its counsel should take advantage of the jury's interest in the dispute to prepare juror-friendly evidence, arguments, and visual aids.

Please join Manatt partner Tom Morrison, The Honorable Paul G. Gardephe (S.D.N.Y), and Paul A. Lee, Special Counsel, Trademarks, Time Inc., as they discuss recent false advertising jury trials. Mr. Morrison has more than 30 years experience trying cases in these fields, including a trio of high profile jury trials—one involving magazine trademarks, one involving generic drugs, and one involving the pizza advertising wars. Lessons from these three cases, as well as several very recent jury trials in this field, will comprise the heart of the presentation.
