Co-Leader of Manatt’s Privacy and Data Security practice Scott Lashway and Special Counsel Matthew Stein wrote an article for Massachusetts Lawyers Weekly on the status of the pending comprehensive privacy laws pending in the Massachusetts legislature, including their unique features and the obligations they could impose on organizations across Massachusetts, from small nonprofits and higher education to large multinational corporations.
In the article, Lashway and Stein explain that even though multiple states have adopted their own comprehensive privacy laws, the Massachusetts legislature has been considering going its own way. “To judge from proposed privacy bills pending before the Legislature, Massachusetts may seek to move to the vanguard of U.S. state privacy laws,” the authors write. They then discuss the details of the pending Massachusetts Information Privacy and Security Act and the Massachusetts Data Privacy Protection Act and how those bills, if enacted, would impact businesses and entities operating both within and outside of Massachusetts.
