California Exactions – One More Time

In his most recent column for Daily Journal, Manatt Appellate Senior Counsel Michael Berger revisits Sheetz v. County of El Dorado, discussing the latest development in the case and recent activity in the U.S. Supreme Court.  
 
In the article, Berger explored the journey of the case through the Court of Appeal and the California Supreme Court, explaining that each time the courts analyzed the condition exacted from the property owner in exchange for a building permit, and noting that the U.S. Supreme Court is likely to issue a more narrow opinion. “The key to this case is whether the kind of scrutiny given to exactions of property in exchange for issuance of a land use permit applies the same when the exaction is mandated legislatively as when it is applied through an administrative process,” he said.
