Examining California's Urgency And Emergency Powers

Manatt government and regulatory partner Brandon Young and associate Jacob Itzkowitz co-authored an article for Law360 analyzing “what constitutes ‘urgency’ or an ‘emergency,’ and the requirements of these emergency powers under California law,” as more elected officials use their emergency powers to enact responses to the current COVID-19 crisis. In the article, Young and Itzkowitz note that while some of these actions may open state and local governments up to challenges from affected businesses and people, it’s important for clients and practitioners to “be aware of the opportunities and limitations of bringing such challenges.”
