VW Emissions Suit Could Open Door to Sweeping Settlement

Law360 interviewed Manatt's Craig Moyer, chair of the firm's Land, Environment and Natural Resources practice, for an article on the U.S. Department of Justice's civil suit against Volkswagen over an alleged auto emissions cheating scheme. Although the suit leaves the door open for separate criminal charges, industry insiders told the publication that the complaint could set the stage for a global settlement that resolves both civil and criminal claims.

Moyer said he thinks a settlement is likely, because the stakes are so big for both sides.

"The challenge in these things is to try to get as close to a global resolution as you can. And there are not only U.S. [Environmental Protection Agency] issues but also state issues and private party claims," he said. "I think the job of VW's management and counsel will be to shepherd this thing towards a resolution process, if not a resolution."
