Jeff counsels businesses on existing environmental compliance and new regulatory programs, and guides companies through the energy facility permitting process. Fortune 10 companies, midsize companies, family businesses, individuals, trade associations and public interest groups are among his clients.
In his environmental litigation practice, Jeff defends clients in civil and criminal environmental enforcement matters. His experience includes cases involving human and ecological exposures to toxic materials, as well as claims of property value diminution due to toxic contamination. In addition, he asserts and defends claims for environmental cost recovery.
When litigation requires, Jeff argues in state and federal appellate courts, including the Supreme Court. A formally trained mediator, he resolves many environmental disputes through mediation. Jeff also represents clients in administrative rulemaking proceedings.
Jeff counsels buyers, sellers and lenders in complex commercial transactions where environmental liabilities need to be identified, quantified and successfully integrated into the transaction. He also advises public companies on the appropriate scope of financial disclosure of environmental matters under various federal regulatory programs. In addition, he prepares contracts, including green supply chain agreements, wherein the primary focus of the agreement involves environmental goods, services or obligations.
Furthermore, Jeff develops and executes complex audit programs, and advises clients on compliance issues involving all of the major federal environmental programs. He creates compliance strategies for emerging regulatory programs, such as the European Union’s RoHS and REACH Directive; and the upcoming climate change regulatory scheme.
