What Could the Supreme Court Vacancy Mean for the ACA?

On November 10, the Supreme Court is scheduled to hear oral arguments in California v. Texas—formerly referred to as Texas v. United States—a lawsuit challenging the constitutionality of the Affordable Care Act (ACA). The passing of Justice Ruth Bader Ginsburg—and the possibility that her replacement could be appointed to the Court prior to November 10—has refocused attention on the politically charged case.

What impact could the decision have on the ACA—and potentially our entire healthcare system? How could the outcome affect the approximately 20 million people who have gained coverage through the ACA’s Marketplaces and Medicaid expansion—and the of tens of millions of other Americans touched by some aspect of the law, such as preexisting condition protections?
