Antitrust and Health Care: What to Expect in 2022

The big technology companies may be making headlines for antitrust scrutiny, but health care is also squarely in the crosshairs for heightened antitrust enforcement. The Federal Trade Commission (FTC) already devotes a substantial share of its resources to antitrust enforcement in health care. In 2020 alone, 46% of FTC enforcement actions were in the health care sector (2021 was similar)—and expectations are that the Biden administration will take an increasingly strict approach to health care competition issues.
