‘Waves of Autodialer Litigation’ Forecast Under State Mini-TCPAs

Leader of the Firm’s TCPA Compliance and Class Action Defense practice Christine Reilly spoke with Communications Daily about the growing popularity of mini-TCPAs that states such as Florida, Oklahoma and Washington are implementing, as well as the growing number of telemarketing lawsuits that may result from this trend. 

Last year’s Florida Telephone Solicitation Act is already producing several class-action lawsuits a day, said Reilly, and a large number of suits is expected as more states add restrictions in addition to the federal Telephone Consumer Protection Act. The U.S. Supreme Court’s April 2021 decision in Facebook v. Duguid, narrowing the definition of auto dialer, produced a “ripple effect,” Reilly commented. “A lot of the state regulators looked at that and there was fear” that Facebook “would open the door to a lot more calls,” she added. Other states are looking to Florida as a model for more restrictions, and Reilly said she expects more states to “join that bandwagon.”
