Supreme Court Rules on 2020 Census Citizenship Question

Uncertainty Dampens Heady Celebration Over Census Win

Manatt’s John Libby, a partner and leader of the firm’s  investigations and white collar defense group, spoke to Courthouse News about the implications surrounding the Supreme Court’s recent decision to stop the Trump administration from adding a citizenship question to the 2020 Census.

The ruling affirmed a lower-court decision to block the Department of Commerce's inclusion of a citizenship question on the 2020 Census and concluded that Commerce Secretary Wilbur Ross's purported reason for adding the question was “contrived."

Libby and a team of Manatt attorneys, along with the Lawyers' Committee for Civil Rights Under Law and Public Counsel, served as counsel to the city of San Jose and the Black Alliance for Just Immigration  in a related citizenship case in California in March. He said he will be “closely watching” the government’s next moves.

“Obviously, this is not the end of the story,” he said. “We’re going to have to see what the government decides to do and whether they are going to continue their efforts to add the question.”
